Terms of Service

These terms are the contract for Where. They are written for people in Norway and the rest of the EEA, including consumers. Read them before you create an account. The English text is the reference text. If you are a consumer living in Norway, you may rely on the Norwegian text.

Who we are

Where is offered at https://where.ltd by the operator of that site, established in Norway. Email: [email protected]. The registered name, organisation number, and postal address belong in this section under the Norwegian Electronic Commerce Act (ehandelsloven). Write to [email protected] and we will send those details and add them here.

Where is an online service for hosting, sharing, and joining events. You can write to us in English or Norwegian at [email protected]. That address is the contact point for users and for authorities.

The contract

These terms form a contract between you and us. They apply when you create an account, sign in, join with an invite code, buy Where+, or otherwise use Where.

You accept them by ticking the box on the signup screen and then creating an account. The box is not pre-ticked. If you use Where as a guest before you have an account, these terms apply to that use from the moment you use the service. You can read this version at any time at https://where.ltd/terms.

If you use Where mainly for a trade or profession, the sections written for consumers do not apply to you. The rest of these terms do. If you use Where as a consumer, nothing in these terms takes away rights you have under mandatory law.

Age

You must be at least 13 to use Where. That is the age Norway sets for consent to an information-society service.

If you are under 18, you may use Where only if a parent or guardian has agreed to these terms for you. You must be at least 18 to buy Where+. A parent or guardian who pays for you is the contracting party for that purchase.

We will close an account if we learn that these age rules are not met.

Your account

You can sign up with an email link, or with Google, Facebook, or Apple when those logins are offered. You give a city, or you share your location, so we can show events near you.

Keep your login to yourself. You are responsible for activity under your account, except where you could not reasonably have prevented it. Use your own name. Do not pretend to be someone else.

Your name, handle, bio, profile photo, and city can be shown on your profile. A temporary guest session is not a full account. When you finish signup, we connect that session to the login you chose.

The service

A host sets up an event with a time, a place, and a description, then invites people or lists it publicly. People in the event can chat and add photos. Photos stay with the event. A host can download them.

The host can keep some details hidden until a person joins. Where+ is an optional paid tier. The Where+ page, as it reads at the moment you pay, describes what that purchase includes. That description is part of the contract for that purchase.

We use people and software to run Where, including to order the feed and to look for content that breaks these terms or the law. We do not read everything that is posted.

How the feed is ordered

The feed and Explore are ordered. The parameters that matter are:

  • whether you asked for friends, public events, or both
  • people you follow, people you have been at events with, and events you are already in
  • how near the event is to the city or location you saved
  • how soon the event starts
  • whether the host has Where+, which can show the event farther away and can give it a featured place when it already ranks close to the top

You can change the mix in settings. A third party cannot pay us to rank an event. Where+ is bought by the host, and the effect of that purchase is described on the Where+ page. The exact weights can change as we improve ordering. The parameters above stay the ones that matter.

Your content

You keep the rights in the text, photos, and other material you post.

You give us a licence to host, store, reproduce, display, and share that material only so we can run Where. That means showing it to the people who are allowed to see that event or profile, keeping a backup, letting a host export the photos from their event, and moderating it. The licence is non-exclusive, worldwide, and royalty-free. It ends when the material is deleted, apart from a short backup period, and apart from copies people in the event already have, including a host's export.

You promise that you have the rights you need. Do not post a photo of another person unless you have the right to, including where the law requires that person's agreement. Do not post a child unless you have the right to, and never in a sexual or exposing way.

An AI picture is made from the prompt you send and from images you choose to attach. We send those to our image provider to make the picture. You receive the rights we are allowed to give you. The picture may not be unique. Do not use it to infringe someone else's rights, or to present a fake event or a fake person as real. We do not use your content to train our own models.

Acceptable use

Do not use Where to:

  • break the law
  • threaten, harass, or incite hatred or violence
  • post sexual content involving anyone under 18, or any content that sexually exploits a child
  • scam, phish, or mislead people about who you are or what an event is
  • spam, or probe, scrape, or disrupt the service
  • upload malware
  • share another person's private information, including a live location, without a right to do so
  • host an event that is a cover for something unlawful

We do not allow content that is illegal under Norwegian law, or under the law of the EEA country the content is aimed at.

Reports and restrictions

If you believe content on Where is illegal, email [email protected] with the subject "Content notice". Include the link, why you believe the content is illegal, and an email where we can reach you. You can use the same address to tell us about content that breaks these terms.

We review notices and remove or limit content that is illegal or that breaks these terms. If we remove your content, limit its reach, or suspend or close your account, we will tell you what we did and why, unless the law forbids that or telling you would harm an investigation, a person's safety, or someone else's rights.

You can ask us to look at that decision again by writing to [email protected] with the subject "Appeal". If someone often posts content that is clearly illegal, we may suspend the account after a warning. We look at how often it happened, how serious it was, and whether it was intentional.

Events and safety

The host organises the event. We do not. We are not the venue, we do not supervise the meeting, and we do not insure it. If you host, you are responsible for the event being lawful, for permission to use the place, for any age limit, and for what you tell guests.

A private invite code is for the people you choose. A public listing is not a promise that a meeting is safe. If you join, you are dealing with the host and the other guests. Meeting people in person has risk. Use your own judgment.

This section does not remove a duty we have under the law, including a duty to act on illegal content once we know about it.

Where+

Where+ is optional. The free service stays available within the limits shown in the product. Before you pay, checkout shows the price, the currency, whether tax is included or added, the period you are buying, and whether it renews. The total you confirm there is the price of that purchase.

The prices we show in Where are in Norwegian kroner: 59 Norwegian kroner for seven days, 149 Norwegian kroner for thirty days, and 1,188 Norwegian kroner for a year. A year is also shown as 99 kroner a month. Checkout may show another currency. A code can lower the price of a week or a month. The year stays at the full price unless checkout shows a different total.

A week is seven days, paid once, and it does not renew. A month is thirty days, paid once, and it does not renew. A year is a subscription. It renews each year at the price shown for that renewal, until you cancel.

The yearly subscription is billed by Stripe. You can cancel it from Where+, or by writing to [email protected]. Cancellation stops the next renewal. You keep Where+ until the end of the period you have already paid for. If the renewal price will change, we tell you before that renewal is charged, in time for you to cancel.

Right of withdrawal

If you are a consumer in the EEA, you may withdraw from a Where+ contract within 14 days without giving a reason. The period starts on the day the contract is made. This right is in the Norwegian Right of Withdrawal Act (angrerettloven).

Write to [email protected] from the email on the account and say that you withdraw. You can use your own words. You can also use the form in the next section. We confirm by email.

Accepting these terms does not waive this right. A pre-ticked box would not waive it either. Where+ starts when payment succeeds so you can use what you bought. If you withdraw within 14 days, we refund what you paid for that purchase. We use the same payment method where we can, within 14 days after we receive your notice. Where+ from that purchase ends on the day you withdraw.

Withdrawal does not affect your rights if the service is not as agreed.

If the service is not as agreed

Where must match what we tell you it does, be fit for the purpose we describe, and have the quality you can reasonably expect.

If you are a consumer and the service is not in conformity, you can require us to bring it into conformity within a reasonable time, at no charge and without serious inconvenience. If we cannot, or the failure is serious, you can ask for a price reduction or to end the paid contract. If you end it, we refund the unused part of what you paid.

These rights follow the Norwegian Consumer Purchases Act (forbrukerkjøpsloven) for digital services, including where the service is free and you provide personal data so we can supply it. We do not limit them.

Personal data

We process personal data to provide Where. The Privacy Notice at https://where.ltd/privacy explains what we collect, why, who receives it, how long we keep it, and the rights you have under the GDPR and the Norwegian Personal Data Act (personopplysningsloven).

Agreeing to these terms makes the contract. It is not a consent to every processing activity in the Privacy Notice. Where we rely on consent, we ask for it separately. You can refuse or withdraw that consent without losing the rest of the service, unless the activity is the thing you asked us to do.

Changes

We may change these terms. If a change materially affects you, we tell you in the product or by email at least 30 days before it takes effect, unless the law requires a shorter time or the change is only in your favour.

If you do not agree, you can close your account before the change takes effect. If you keep using Where after that date, the new terms apply. A change that is unfair under mandatory consumer law does not bind you.

We may change, add, or remove features. If we stop a paid feature during a period you have already paid for, and we do not offer a reasonable replacement, we refund the unused part of that period. A later purchase is charged at the price shown before you pay.

Closing an account

You can close your account by writing to [email protected]. We delete or anonymise personal data as the Privacy Notice describes, unless the law requires us to keep some of it.

We may suspend or close an account, or remove content, for the reasons in Reports and restrictions. If we stop offering Where, we tell you in advance when we reasonably can, and we refund the unused part of a period you have paid for.

Liability

We provide Where with reasonable care. We are responsible for foreseeable loss caused by our failure to do that, and for a lack of conformity, as the section on conformity describes.

We are not liable for what other people do, for an event, or for a meeting in person, except where the law makes us liable, including where we know about illegal content and do not act as the law requires.

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, for gross negligence or intent, or for a liability that cannot be limited under the law that applies to you.

If you use Where as a business, our liability for one claim is limited to the amount you paid us for Where+ in the three months before the claim, except where the law does not allow that limit. That cap does not apply to consumers.

Law and disputes

Norwegian law governs these terms.

If you are a consumer, this choice does not take away the mandatory protection of the law of the EEA country where you live. You may bring a case in the Norwegian courts, or in the courts of the EEA country where you live. We will sue you as a consumer only in the courts of the country where you live, unless a mandatory rule says otherwise.

If you are not a consumer, the courts at our place of business in Norway have venue.

Write to [email protected] first if you can. We want a chance to put the problem right. If you are a consumer, you can also contact the Norwegian Consumer Council (Forbrukerrådet) and the European Consumer Centre Norway (Forbruker Europa).
